Personal Data

The controller of your personal data, as defined by personal data protection regulations, is Elpolap, a limited liability company with its registered office in Zalasewo (62-020), at ul. Orzechowa 21, registered in the Business Register by the District Court for Poznań Nowe Miasto-Wilda in Poznań under KRS number 0000998412, NIP 777 339 64 75, REGON 523459038, with share capital of 5,000 zlotys (fully paid up).

The purposes, legal bases, and duration of personal data processing are specified separately for each purpose of data processing (see the provisions below containing a detailed description of the various purposes of data processing).

In connection with our processing of your personal data, you have the following rights:

  • the right to request access to your personal data, to have it corrected, deleted, or to restrict its processing,
  • the right to object to the processing,
  • the right to data portability,
  • the right to withdraw consent to the processing of personal data for a specific purpose, if you have previously given such consent,
  • the right to lodge a complaint with a supervisory authority regarding our processing of personal data.

You may exercise the above rights in accordance with the rules set forth in Articles 16–21 of the GDPR by contacting us at biuro@elpolap.com.pl.  We may refuse to grant you certain rights listed above if exercising a particular right would conflict with a legitimate purpose of our data processing. For example, we may refuse to delete the personal data contained in an order you have placed until the statute of limitations for claims arising from a contract concluded through the store has expired.

Providing your personal data is always voluntary, but it is necessary to create an account on the website, place an order, subscribe to the newsletter, contact us, withdraw from a contract, or file a complaint.

We guarantee the confidentiality of all personal data you provide to us. We ensure that we take all security and data protection measures required by data protection regulations. Personal data is collected with due diligence and adequately protected against access by who are not authorized to do so. Personal data is processed exclusively within the European Union.

How Long We Store Your Data

If you leave a comment, its content and metadata will be retained indefinitely. This allows us to automatically recognize and approve subsequent comments without sending them for moderation each time.

We also retain also store data from users who have filled out the request-for-quote form (free quote) on our website. Any user can view, correct, or delete their personal information at any time. Website administrators can also view and modify this information.

What are your rights regarding your data

If you have filled out the contact form or posted comments on this site, you can request a file containing an export of all your personal data that we hold, including all data you have provided. You may also request that we delete all of your personal data in our possession. This does not apply to any data that we are required to retain for administrative, legal, or security reasons.

Entrusting Data Processing to Third Parties

With regard to any websites linked to on the Website that are not owned or controlled by the Administrator, the Administrator assumes no responsibility for their content or for the privacy policies applicable to Users. When displaying a web page containing such a link, the User’s browser establishes a direct connection with the servers of social media administrators (service providers). The content of the plugin is transmitted by the respective service provider directly to the User’s browser and integrated into the webpage. Through this integration, service providers receive information that the User’s browser has displayed the Administrator’s webpage, even if the User does not have a profile with that serviceor is not currently logged in. This information (along with the IP address) is transmitted by the User’s browser directly to the service provider’s server (some servers are located in the U.S.) and stored there. If the User is logged into one of these social media platforms, that service provider will be able to directly associate the visit to the Administrator’s website with the User’s profile on that social media platform. If the User uses a given plugin—for example, by clicking the “Like” or “Share,” the relevant information will also be sent directly to the provider’s server and stored there. Furthermore, this information will be published on the social media platform and will be visible to the User’s contacts. The purpose and scope of data collection, as well as the further processing and use of the data by the service providers, along with contact information, the User’s rights in this regard, and the options for configuring privacy settings, are described in the privacy policies of the respective service providers.

If the User does not want social media platforms to associate data collected during visits to the Administrator’s website directly with the User’s profile on a given platform, they should log out of that platform before visiting the website. The User may also completely prevent plugins from loading on the website by using appropriate browser extensions, such as script blockers.

The Administrator processes the personal data of Users who visit the Administrator’s profiles on social media (Facebook, Instagram, YouTube, Twitter, Google+, LinkedIn). This data is processed to inform Users about the Administrator’s activities, to offer services, and to communicate with Users via tools available on social media. The legal basis for processing personal data for this purpose is the Administrator’s legitimate interest (Article 6(1)(f) of the GDPR), which consists of promoting its own brand and the services it offers, as well as building and maintaining a community associated with the brand.

Within the Website, the Administrator may automatically tailor certain content to the User’s needs, i.e., perform profiling, using the personal data provided by the User for this purpose. This profiling primarily involves automatically assessing which products the User may be interested in, based on their previous online activity—including on the Controller’s websites—and displaying product advertisements tailored in this way. The profiling carried out by the Administrator does not result in decisions that produce legal effects on the User or affect them in a similarly significant manner.

Provision of Services

Contact Form

On the elpolap.com.pl website, users can submit a request for a quote, based on which a preliminary estimate is provided free of charge. When filling out the form, users must provide contact information such as: First and Last Name, Email, Phone Number, company name. The user then provides detailed information about the project, which allows us to understand their needs and expectations and, consequently, prepare a free quote. The information provided is sent to our email and entered into our CRM system. 

Providing your contact information in the form constitutes consent to be contacted for the purpose of presenting a commercial offer. 

Your personal data provided in this form is processed for the time necessary to complete the decision-making process regarding potential cooperation. You may decide to delete the provided data at any time, which will also result in the removal of your personal data from our database.

Free Audit

On the elpolap.com website.pl, users can submit a request for a free audit, based on which an initial analysis of the selected social media profile is conducted. The basic audit is free of charge. When filling out the form, users must provide contact information such as: first and last name, email, phone number, company name, or a link to their social media profile. Next, the user provides detailed information about the project, which allows us to understand their needs and expectations and thus perform the free audit. The information provided is sent to our email and entered into our CRM system. 

Providing your contact information in this form constitutes your consent to be contacted for the purpose of receiving a commercial offer. 

Your personal data contained in this form is processed for the time necessary to complete the decision-making process regarding potential cooperation. You may decide at any time to have the provided data deleted, which will also result in the removalfrom the database.

Newsletter / Direct Marketing via Email

Through the website www.fraktal.studio, you can subscribe to a newsletter containing information about new products, promotions, products, and services related to the website. In order to send you the newsletter, we process your personal data, including your first name, email address, and activity on the website (e.g., to provide personalized recommendations for blog content or products).

The legal basis for processing your personal data in connection with the newsletter is your consent, which you provide by checking the appropriate checkbox when subscribing to the newsletter. You may withdraw this consent at any time by unsubscribing from the newsletter.

Your data will be processed for as long as the newsletter is active, unless you decide to exercise your right to be forgotten, which will result in the deletion of your data.

Email Contact/Contact Form 

When you contact us via email, you naturally provide us with your email address as the sender’s address. In addition, you may also include other personal data in the body of the message.

The legal basis for processing personal data in this case is your consent resulting from your decision to contact us.

Your personal data provided to us via email is processed solely for the purpose of handling your inquiry. The content of the correspondence may be archived.

Recovering Abandoned Forms

Our website is equipped with a mechanism for recovering abandoned forms. This means that if you fill out half of the free quote form and then leave the page, you may receive an email reminding you that you can complete the form. For the purposes of this procedure, your personal data related to the incomplete quote request will be processed.

Using the widget that allows you to share content on social media platforms implies acceptance of cookies from Facebook and other social media platforms.

Third-party cookies are also used for remarketing and for the statistical purposes described below.

Cookies Used for Statistical Purposes

We use cookies to track website statistics, such as the number of visitors, the type of operating system and web browser used to view the site, time spent on the site, pages visited, etc. We use Google Analytics for this purpose. The information collected in this regard is completely anonymous and does not allow for your identification.

Marketing Cookies 

We use cookies to conduct remarketing activities, which involve showing you ads encouraging you to return to the website or take advantage of promotions, discounts, etc. We also use tracking codes from platforms such as Facebook, Google Ads, LinkedIn, and TikTok, which allow us to target you with ads on each of these platforms.  

WordPress System Cookies

If you leave a comment on our website, you’ll have the option to save your name, email address, and website address in cookies, so that when you write future comments, this information will already be conveniently filled in. These cookies expire after one year.

If you have an account and log in to this site, we’ll set a temporary cookie to check whether your browser accepts cookies. This cookie contains no personal data and will be deleted when you close your browser.

When you log in, we also set several cookies to save your login information and your screen display choices. Login cookies expire after two days, and screen display options after one year. If you select the “Remember Me” option, your login will expire after two weeks. If you log out of your account, the login cookies will be deleted.

If you edit or publish an article, an additional cookie will be stored in your browser. This cookie does not contain any personal data; it simply refers to the ID of the post you just edited. It expires after 1 day.

Comments

When a visitor leaves a comment on the site, we collect the data visible in the comment form, as well as the visitor’s IP address and browser fingerprint to help detect spam.

An anonymized string created from your email address (also known as a hash) may be provided to the Gravatar service to check whether you are using it. Gravatar’s privacy policy is available here: https://automattic.com/privacy/. Once your comment is approved, your profile picture will be publicly visible alongside your comment.

Guest comments may be checked through an automated spam detection service.

Media

If you are a registered user and upload images to the site, you should avoid uploading images with EXIF location tags. Website visitors can download and read the full location data from images on the site.

Additional Tracking Tools

The website is equipped with additional tools that allow us to track users visiting the site and record so-called “heat maps,” which show where the mouse cursor moves. The data is recorded in both text and graphical formats—we do this to improve the website, enhance the user experience (UX), and generate personalized shopping recommendations on the website and in emails.
